Terms of Service

Welcome to ConnectBuild ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our construction marketplace platform, including our website, mobile applications, and related services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the modified Terms.

"Customer" refers to homeowners or commercial property owners seeking construction services. "Contractor" refers to verified construction professionals offering services on the Platform. "Project" refers to construction work posted by Customers on the Platform. "Bid" refers to a proposal submitted by a Contractor in response to a Project. "Platform Fee" refers to the 2% fee charged to Contractors on accepted bids.

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you meet this age requirement.

For Contractors: You must possess all required licenses, insurance, and certifications mandated by federal, state, and local laws to perform construction work in your jurisdiction. You agree to maintain these credentials throughout your use of the Platform.

• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

ConnectBuild provides: A marketplace platform connecting Customers with Contractors; Tools for posting Projects and submitting Bids; Messaging and communication features; Contractor verification services; Payment processing facilitation (through third-party processors); Review and rating systems.

IMPORTANT: ConnectBuild is a platform provider only. We do NOT: Employ Contractors or act as an employer; Perform construction work; Guarantee the quality of work performed; Act as a party to contracts between Customers and Contractors; Provide construction advice or recommendations.

• Provide accurate and complete Project information
• Respond to Bids in a timely manner
• Review Contractor credentials before accepting Bids
• Enter into written contracts with Contractors for work performed
• Make payments directly to Contractors according to agreed terms
• Obtain necessary permits and approvals for Projects
• Provide honest reviews and feedback

• Maintain valid licenses, insurance, and certifications
• Provide accurate Bids and honor committed timelines
• Perform work professionally and in compliance with applicable laws
• Respond to Project invitations within 48 hours
• Keep license and insurance documents current (uploaded within 30 days of expiration)
• Communicate clearly and professionally with Customers
• Complete Projects according to agreed terms
• Pay Platform Fees when Bids are accepted

For Customers: No Platform Fees — Customers do not pay fees to ConnectBuild for posting Projects or accepting Bids. Additional Invitations: Customers may pay a fee to invite additional Contractors beyond the first 3 free invitations. Direct Payment: All project payments are made directly to Contractors outside the Platform.

For Contractors: Platform Fee — A 2% fee is charged on the total amount of accepted Bids. Subscription Plans: Monthly or annual subscription fees may apply based on chosen plan. Payment Processing: Fees are processed through third-party payment processors (Stripe). No Hidden Fees: All fees are clearly disclosed before acceptance.

Platform Fees are non-refundable once a Bid is accepted, even if the Customer and Contractor later terminate the agreement.

All Contractors must complete a verification process that includes: Valid contractor license verification; Proof of liability insurance; Business information validation; Identity confirmation.

Verification does not constitute an endorsement or guarantee of quality by ConnectBuild. Customers should conduct their own due diligence.

ConnectBuild's IP: All content, features, and functionality of the Platform are owned by ConnectBuild and protected by copyright, trademark, and other intellectual property laws.

User Content: By posting content on the Platform, you grant ConnectBuild a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content for Platform operations and marketing purposes.

You retain ownership of your content and are responsible for ensuring you have the rights to post it.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

ConnectBuild disclaims all warranties, including but not limited to: Quality, accuracy, or reliability of Contractor work; Accuracy of information provided by users; Uninterrupted or error-free Platform operation; Security of data transmission; Results obtained from Platform use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONNECTBUILD SHALL NOT BE LIABLE FOR: Indirect, incidental, special, consequential, or punitive damages; Loss of profits, revenue, data, or goodwill; Damages arising from Contractor work quality or Customer conduct; Disputes between Customers and Contractors; Property damage or personal injury resulting from Platform use.

Our total liability shall not exceed the amount you paid to ConnectBuild in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify, defend, and hold harmless ConnectBuild, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from: Your use of the Platform; Your violation of these Terms; Your violation of any rights of third parties; Your content posted on the Platform; Work performed by or for you through the Platform.

Binding Arbitration: Any dispute arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) rules, rather than in court, except where prohibited by law.

Class Action Waiver: You agree that disputes will be resolved on an individual basis and waive your right to participate in class actions or class arbitrations.

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any legal action or proceeding related to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York.

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms.

You may terminate your account at any time through the Settings page. Upon termination, your right to use the Platform will immediately cease.
